Right of Withdrawal

1. Right of withdrawal for consumers
Consumers (§ 13 BGB) have a statutory right of withdrawal under §§ 312g, 355 BGB for contracts concluded by means of distance communication or off-premises. You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract. For contracts concluded in our store (intake of your device on premises), there is generally no statutory right of withdrawal as the rules for distance contracts do not apply.
2. Exercising the right of withdrawal
To exercise the right of withdrawal, you must inform us by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. Address the withdrawal notice to:

You may use the model withdrawal form below, but it is not mandatory. To meet the withdrawal deadline it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
3. Early expiry of the right of withdrawal for repair services
Important: For service contracts — including a repair commissioned by you — the right of withdrawal expires once FixXpert has fully performed the service if performance only began after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal upon full performance of the contract by FixXpert (§ 356 (4) BGB).
In practice this means: as soon as you expressly approve the repair and we start it, the contract can usually no longer be withdrawn free of charge. If you withdraw before the repair is completed, you are required to pay us a proportionate amount for the services already provided up to the time of withdrawal — provided we received your express request and your acknowledgement of loss of the right of withdrawal before performance began.
4. Consequences of withdrawal
If you validly withdraw from this contract, we shall reimburse you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal. We will use the same means of payment as you used in the original transaction, unless you have expressly agreed otherwise; in no case will you be charged for this reimbursement.
If you requested that the repair services begin during the withdrawal period, you are required to pay us a reasonable amount corresponding to the proportion of services already performed up to your withdrawal compared to the total scope of the services foreseen in the contract.
